Finally, I enjoy BK's eternal optimism in the face of crashing servers and absurd content. It takes grande cojones to do this everyday and I respect that. Really. It may diminish your opinion of me (if that's possible ), but, frankly, I'm a fan of the show. I enjoy the videos. I don't watch them with the same sense that I'm owed something particular from the story. I was sucked in because I thought it was a phenomenal way to tell the story, and I liked the characters. I'm still intrigued by the story they're telling and wondering where it will go next. I would only be disappointed if nothing happened.

Heh...I didn't know what it said. I was defending the video. I think it's cool...I like the idea of more action (or more potential action). As for the bad grammar, I'm guessing it was due to a translator (software or device) reading the English version. (Some have said the Spanish is being read over a much softer English version.) We all know software adds a ton of grammar problems in translation. At least, I hope that's what it is.

Hey Everyone,
Okay, we've read all your responses and agree with many of your thoughts. Also, we've reflected some more and looked at the TOS for other websites. First, we want to clarify again what our goals are:
1) We need to own our show and retain our copyright so that we can attract investment and continue to produce shows for your enjoyment. That's why our whole team works so hard every day. We love producing internet shows and we want to keep doing it.
2) We want you to produce fan fiction on our website legally.
3) We want you to produce original shows on our website and we want YOU to own your original shows.
Every website we went to has a similar TOS (Yahoo/Flickr, YouTube, MySpace, etc.) as it pertains to the use of user submitted content. We're going to follow their lead since it has precedent and because we think it is fair. Here is what we propose:
1) When a user submits content (videos, images, etc.) to our website (via a YouTube embed or direct upload), you are giving us the "non-exclusive, worldwide, perpetual license" to use that content however we want. If a user removes that content from our website, then that license is revoked. This is IDENTICAL to the YouTube license and it will apply to ALL videos, images, etc. uploaded or embedded on our website. If it is ORIGINAL content, then you own it (see below). If it is DERIVATIVE content, then you will own those physical pieces of content you create, but your use of that content is limited (see below).
2) We will license our shows (lonelygirl15, KateModern, etc.) under the Attribution-NonCommercial-ShareAlike 3.0 Unported license. This means that you can LEGALLY create fan fiction using our videos and ideas. You can talk about Watchers/Shadows/Elders/TRAIT:POSITIVE/lonelygirl15 etc. in those videos, you can use pieces of footage from our videos, audio, songs (the HOO song), etc. All of this is LEGAL, but you can only use those videos for non-commercial purposes and according to the terms of the above license. For attribution we want a link back to our website if you post the videos on other sites (we may provide graphics/banners at some point).
3) If you create ORIGINAL videos and shows on our website, then you can choose to license it however you want. YOU OWN the original shows you create. As soon as we can, we'll put up check boxes for you to assign whatever Creative Commons license you want to those videos, but in the meantime the ownership of your content will be covered by standard copyright (you own it, all rights reserved). Also note that the blanket TOS discussed in (1) applies to these original videos you upload/embed on our site (we can do what we want with those videos while they are on our site, just like YouTube).
We think this is fair and protects us, but allows you guys to express your creativity. Understand that this is basically unprecedented. EVERY STUDIO on the planet considers ALL fan fiction ILLEGAL. We are making it so that you can legally create fan fiction for non-commercial purposes. At some point when we can do it we may even PAY YOU for the fan fiction and original work you post on our site. We will treat ORIGINAL content on our site just like everyone else on the internet does (YouTube, Flickr, etc.).
Why do we need that "non-exclusive, worldwide license" for all the content you upload? For the same reason YouTube needs it. We need to be able to monetize our website legally even if your content is on it. We don't want to make a movie or TV show using your ideas. We don't want to make a DVD and put your videos on it. We will ask you for permission if we ever want to do that, and we would only do it because it would be super cool to have people see your amazing videos on a DVD.
You've asked a lot of questions about "what's okay to use." Honestly, intellectual property is blurry and it all depends on whether someone sues and what the court decides. We don't want to sue you guys for making fan videos. That's not our intent. We want to allow you to legally create fan videos, but we can't be in a position where you could legally pitch and sell a show like KateModern! So, we think that the non-commercial license gives you the freedom to make videos and also allows us to protect our IP. What is our IP? All the characters and ideas in the show. The main characters, Watchers, Ceremony girls, TRAIT:POSITIVE, Helpers, Shadows, Elders, the Order, the Resistance, the Hymn of One, and all the other ideas in the series. Anything you guys create that uses or builds on these ideas is a derivative work... you can do it... and we WANT you to do it, but it will fall under the non-commercial use license. Obviously using the actual video, audio, graphics, watcher symbols, other symbols and logos, etc. in your videos, make them derivative works that fall under the non-commercial use license.
What's original? Well, anything else! Videos you create that are original are owned by you. We want you to create and OWN original shows on our website. In fact we will be making it easier for you to tell stories on our website as soon as we have the resources.

second? jsmith being the first? i seem to recall at least one other name also. No, the programmer's name popped up in some script somewhere and was mentioned. He asked that his name not be revealed. I will mention to them both that they could be credited in the LGpedia, but I think they plan on staying behind the scenes.

Thank you for raising this as an issue here, Slainte! I did, in fact, start a Street Team for LG15! (I only read the subject of your message and not the post itself, so I am assuming that you're eager to find out more information!)
The Street Team will work like those for bands. If you're a fan, you can distribute fliers and spread the word, with the goal being to get new fans to the show and registered on the website. And by doing so, you can get t-shirts and other stuff.
It's a great way to get your friends and coworkers interested in the series. I'm glad to hear you're interested, Slainte!

Actually, it snowballed on LG15 Today. There were exactly two posts (in two different places) that mentioned this on the phorum. I don't know why most of the discussion was taking place on the blog instead of the forum (you'd think if they were so angry they'd want the c's to know about it.) Hey... how do we know you weren't just deleting those posts? ooooooooh, I smell a conspiracy! There seems to be a feeling that you're more anonymous on the blog, I think. See the number of anonymous posters. Note that the reply from virginian9000 is more aggressive on LG15 Today than on the forum. I didn't delete anything. It's an interesting conversation, and I'm glad to see that it worked itself out. Not my fault no one took brought it up there.

I think what did\does surprise me (and makes it hard to believe it is true) about a DoS attack on LG, is that it is directed at LG. Unless it is some punk script kiddies (which is actually often the cause for a DDoS) as usually one needs to first release a virus to capture a bunch of drones that can be used as a botnet to attack the site - that is a lot of hassle to go through for such a relatively unknown site. Probably was the result of all the press and recognition on myspace bringing out the script kiddies. This is evident by the fact that there were about 30 people on the site and it was running so sluggishly. The programmer was blocking access to IP attacks all Friday evening and Saturday, and it would get better, then slow down again. The downtime last night was due to some upgrades. They were splitting traffic more efficiently across servers and adding additional firewalls to block those type of attacks. Unfortunately, they didn't give enough notice to inform folks it would happen. But the site is running quick today! Heh...that wouldn't surprise me! I also sense a conspiracy here. Terryfic shows up on the site to upload a video response and logs into the phorum for the first time in at least three years, and suddenly things are running painfully slow. Surely those two things are related.
