Hmm... Smashing is right, I misread the law. In California is it in fact a misdemeanor. Like trash said, a civil penalty up to $2,000.
I will guess, however, that this is unprosecutable. I don't know what the other pertinent laws would be, but think about what this law says.
Imagine a young teen couple, born Nov. 13, 1988 and Nov. 20, 1988. It was perfectly legal for them to have sex last week. It's perfectly legal for them to have sex next week. But this week they are breaking the law?
I won't read through California case law to find it, but I'm sure there's some wiggle room here. There's also the matter of Bree's religion. "Do what thou wilt." Bree and Daniel can go for it, if she's up for it. I mean, those were nice flowers.

Super cute moment that also denotes a level of maturity that may be lacking here. I don't think Daniel will need a lawyer anytime soon. She is warming up a bit though.
